JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 399, 401, 413 and 414 of the Indian Penal Code. The allegation is that at 11 A.M. the police apprehended four persons from the road side and they were found in possession of a looted motorcycle and one mobile set.
Learned counsel appearing for the petitioner submits that the allegation is false and concocted. The petitioner has falsely been implicated in the present case. He was apprehended by the police but no vehicle was recovered from his possession. The petitioner is in custody since 02.08.2016. The other similarly situated accused persons have earlier been granted bail. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.54160 of 2016 (2) dt.21-12-2016 2/2 the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Town Thana P.S.Case No. 359 of 2016.
