16.07.2020 Heard Mr. Ravi Sahay, learned counsel for the petitioner and Mr. Nand Kishore Prasad, learned counsel for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bhabhua P.S. Case No. 403 of 2019 instituted for the offences under Section 379 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that his implication in the present case is on the basis of confession of a co-accused person, who was arrested in connection with one of the cases listed in paragraph -3 of the bail petition. The petitioner has been granted anticipatory bail in one of the cases referred to above and the aforesaid fact has been stated in paragraph-8 of the petition.

Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of this order on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabhua, Kaimur in connection with Bhabhua P.S. Case No. 403 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
