JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends her arrest in connection with Mansi P.S. Case No. 233 of 2016 registered for the offences punishable under sections 467, 468, 471, 420, 204 and 120(B) of the Indian Penal Code. Allegedly the petitioner obtained 61% marks in Intermediate examination, but in the last panel list, her percentage was shown 71.55 and accordingly, she has been appointed as Teacher.

Submission is that the petitioner has applied after showing real marks, which is evident from her application form, which is attached with the First Information Report. She has not

No.6965 of 2017 (2) dt.22-02-2017 2/2 done any manipulation and if any fault committed that on the part of the person, who has prepared the final panel list so the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that in the application form of the petitioner, there is no manipulation and further the marks, which was supplied, which is attached with the First Information Report, there is no manipulation. In the facts and circumstances as stated above, the petitioner, above named, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 233 of 2016, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
