JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Nawada Town P.S. Case No. 453 of 2016 registered under Sections 272 and 273 of the Indian Penal Code and Section 47(A)(B)(C) of Bihar Excise (Amendment) Act.

The accusation is of recovery of 246 litres Indian Made Foreign Liquor from the Maruti Alto Car, which was standing near the house of Mantu Singh and also 290 litres Indian Made Foreign Liquor recovered from the house of Mantu Singh, from where, Pappu Singh, husband of petitioner no. 1, was arrested, who disclosed the name of his brothers, namely,

Patna High Court Cr.Misc. No.53369 of 2016 (3) dt.09-01-2017 Mithilesh Singh @ Mantu Singh and Dipu Singh, husband of petitioner no. 2 who succeeded to flee away.

Learned counsel for the petitioners submits that, in fact, both petitioners are wife of co-accused, Pappu Singh and Dipu Singh, so they have falsely been implicated in this case while they were not present at the house in course of raid. It is further submitted that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 453 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
