JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-06-2022 Heard learned counsel for the petitioner, learned APP for the State and Mr. Bindhyakeshri Kumar, learned Senior Counsel assisted by Mr. Ravi Shankar Pandey, appearing on behalf of the informant.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The prosecution case, in brief, is that Rs.3,80,000/- was given to the petitioner as a consideration amount for the land which was purchased by the informant. Later on, it transpired that the transaction, which he has made, was completely fake as the land did not belong to the petitioner. Learned counsel for the petitioner submits that the

It is submitted that the disputed land was purchased by the petitioner by one Arun Kumar vide registered sale deed dated 06.06.2018. Thereafter he applied for mutation of the land and the said land has been mutated in favour of the petitioner. Later, dispute arose between the parties and the mutation has been cancelled by the court concerned. Thereafter the petitioner filed appeal against the said order. Learned Senior Counsel for the informant opposed the prayer for anticipatory bail of the petitioner and submitted that by playing fraud, the petitioner has sold the said land to the informant. It is further submitted that a Mutation Appeal No.01/19-20 was filed before the Court of L.R.D.C., Sonepur at Saran who by order dated 19.09.2019 cancelled Mutation Case No.1620/405/2018-19.

Taking into consideration the fact that there is land dispute between the parties, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Saran at Chapra in
