JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-09-2023 This application has been filed for quashing the FIR of Excise Case No. 592 of 2019, registered for the offence punishable under Section 30 (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

2. The learned counsel for the petitioners has submitted that the illicit country-made liquor was not recovered from the house of the petitioners and they have falsely been implicated in this case.

3. The seizure list shows that the petitioners were named in column 2. On police raid, the petitioners became successful in fleeing away, but after excavation of the land, the

Patna High Court CR. MISC. No.9672 of 2021(2) dt.12-09-2023 2/2 illicit country-made liquor was found/recovered. The specific allegation against the petitioners is that they were involved in a case under Section 30 (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

4. I do not find any substance in the present petition to quash the FIR of Excise Case No. 592 of 2019.
