JUSTICE PARTHA SARTHY ORAL ORDER 23-09-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Naubatpur P.S. Case No.21 of 2020, registered under sections 386, 387 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act. As per allegation in the F.I.R., it is stated that on secret information having been received about extortion being carried out by some boys in the market, a raid was conducted and some of the accused persons were caught. It is submitted by learned counsel for the petitioner that except for the confessional statement of a co-accused made before the police there is no other material against the petitioner. No incriminating article has been recovered from her possession. She is a lady having no criminal antecedent. The application for bail is opposed by learned APP for the State who submits that the accused persons caught has categorically disclosed that he worked for this petitioner. Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner including the petitioner not having any criminal antecedent, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of her arrest or surrender in connection with Naubatpur P.S. Case No.21 of 2020, she will be enlarged on bail on furnishing bail bond of Rs 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.
