The petitioner is the husband of the victim/deceased and is facing prosecution under Sections 304 B and 201/34 of the IPC vide Belhar P.S. case no. 103 of 2014 and prays for grant of bail.

It is stated that the father of the victim in his statement narrated the real cause of death of the victim. The petitioner is in custody since 14.02.2015. This Court, by order dated 22.08.2016, directed the Superintendent of Police, Bank to produce the investigating officer for his evidence and a report was called for.

Patna High Court Cr.Misc. No.35705 of 2016 (3) dt.28-11-2016 is received and placed at Flag-'P' wherefrom it appears that the Investigating Officer was only left to be examined in the trial vide Sessions Trial No. 192 of 2015.

Mr. Mukherjee, on instruction, states that now the Investigating Officer has also been examined and the case is fixed for the defence evidence.

Considering the above, I do not find any merit in the present application. It is, accordingly, dismissed. Let the trial Court expedite the trial.
