JUSTICE RAJESH KUMAR VERMA ORAL ORDER 20-09-2024 Heard Mr. Shubhesh Pandey, the learned counsel for the petitioner and Mr. Satyendra Prasad, the learned Additional Public Prosecutor for the State.

Petitioner seeks regular bail who is in custody since 26.10.2016, in connection with Barauni (Chakiya) P.S. Case No. 382 of 2016, FIR dated 26.10.2016, registered for the offences punishable under Sections 115, 353, 307 and 34 of the Indian Penal Code and under Section 25(1-b)a, 26, 27 and 35 of the Arms Act.

Earlier the petitioner has moved before this Hon'ble Court in Cr. Misc. No. 71331 of 2022, which was rejected vide order dated 08.05.2023.

According to the prosecution case, after receiving information that a criminal who is wanted in double murder case

No.24661 of 2024(6) dt.20-09-2024 2/3 was seen going towards Diara with his associates, the police party reached at the alleged place, however, the miscreants started firing over the police party. It is further alleged that two persons were apprehended at the spot and from the possession apprehended persons huge quantity of fire-arms were recovered. 5.

Vide order dated 02.08.2024, a report was called for with regard to the stage of the trial and report dated 06.09.2024 of the learned trial Court reveals that all the prosecution witnesses have been examined and case is pending for the examination of defense witnesses.

The learned Additional Public Prosecutor for the State on the other hand has vehemently opposed the prayer for bail of the petitioner and submits that from bare perusal of the FIR, it appears that there is specific allegation against the petitioner in the FIR. Apart from that, petitioner carries 28 cases other than the present of almost similar nature. 7.

Considering the aforesaid facts and circumstances as well as the report of the learned trial Court, I am not inclined to enlarge the petitioner on bail in connection with Barauni (Chakiya) P.S. Case No. 382 of 2016, pending in the Court of learned Additional Session Judge-II, Begusarai. 8.

Prayer is refused.
