JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.

The informant is Mahanth of the referred temple from where unknown persons stolen away idols. Submission of the learned counsel for the petitioner is that the local circle officer has lodged Gorea Kothi Police Station Case No.83 of 2016 suspecting involvement of the informant of the case in the theft alleged. Nothing has been recovered from the possession of the petitioner and petitioner has got no criminal antecedent.

No.13462 of 2017 (5) dt.21-06-2017 2/2 Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/Successor Court in connection with Gorea Kothi Police Station Case No.82 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
