The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on account of dispute the accused persons, including the petitioner came and assaulted the informant on 02.07.2021, further Vivek, Vickey and the petitioner assaulted the informant with sharp edged weapon causing injury on head, further his brothers were also assaulted by named accused persons excluding the petitioner by sharp edged weapon causing injury on head and hand and Dinesh fired.

No.20566 of 2022(2) dt.27-09-2022 2/3 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the allegation of assault is also general and omnibus in nature though it has been alleged that Vickey, Vivek , Naresh and petitioner assaulted but then the injury of the informant is simple in nature caused by hard and blunt substance which belied the allegations, further as it has been pleaded in Para-12 of the anticipatory bail application, it is also submitted that petitioner is working as a cook in a restaurant namely Paprika situated at Gandhi Maidan, Gaya and he has been living in Gaya since long back and on the date of occurrence also he was not present at the place of occurrence. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sirdala P.S. Case
