The petitioner apprehends his arrest in Mahua P.S. Case No.502 of 2015 registered under Section 393 of the Indian Penal Code.
The prayer for anticipatory bail of the petitioner was earlier rejected by order dated 25.07.2016 passed in Cr. Misc.No.21473 of 2016.
Learned counsel for the petitioner submits that the petitioner was granted bail by police on his personal bond. The anticipatory bail petition was earlier dismissed as withdrawn. It is further submitted that now Warrant of Arrest has been issued against the petitioner.
From perusal of records, it appears that the petitioner and others made an attempt to snatch the motorcycle of the
Patna High Court Cr.Misc. No.63191 of 2018(2) dt.13-02-2019 2/2 informant and the name of petitioner transpired during course of investigation.
Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders before the court below, the court below shall consider the regular bail of the petitioner on its own merit without being prejudiced from the order of this court and, if possible, the court below shall dispose of the regular bail petition of the petitioner preferably on the same day.
