2. The petitioner has preferred this application for grant of regular bail in connection with Session Trial No. 495/2024 arising out of Danapur P.S. Case No. 1568 of 2023 dated 14.12.2023 registered for the offences punishable u/s 302 of the Indian Penal Code in which the charge-sheet has been submitted under Section 306 of the Indian Penal Code and the cognizance was also taken u/s 306 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is alleged to have abducted the informant's daughter and killed her by hanging.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no eyewitness to the alleged occurrence. It is further submitted that the deceased herself committed suicide and immediate information was given to the police. It is further submitted that during the course of the investigation, the house owner, namely, Amarendra Kumar and his wife Savita Devi have allegedly stated that the petitioner was the tenant of their house for one month and on 14.12.2023 in the evening, they found that the petitioner was knocking at the door. It is further submitted that after breaking the door they found that the deceased, Punam Kumari was hanging with the fan and immediately police was informed. Learned counsel has further submitted that the charges were framed on 08.10.2024 but till date no witness has been examined and there is no chance of conclusion of the trial in near furture. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.12.2023.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and stated that there is direct allegation against the petitioner of abducting the informant's daughter and hanged her to death. The regular bail application of the petitioner was earlier rejected by this court vide order dated 27.08.2024 passed in Cr.Misc. No. 26008/2024.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Sessions Trial No. 495/2024 arising out of Danapur P.S. Case No. 1568 of 2023 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
