JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-376, 379 & other minor Sections of the Indian Penal Code and 8 of the POSCO Act.
Petitioners and three others including co-accused Sunil Kumar are named in the first information report with allegation that they, having entered the house of the informant committed loot and also, made attempt to commit rape upon her. However, it would appear from the record that after investigation, police found the accusation untrue in respect of the petitioners and, only coaccused Sunil Kumar was charge sheeted by the police.
Patna High Court Cr.Misc. No.38644 of 2016 (2) dt.17-09-2016 2/2 Learned counsel for the petitioners submits that the coaccused Sunil Kumar has already been granted privilege of bail by a coordinate bench of this court.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Jehanabad Mahila P.S. Case No. 22 of 2016 to the satisfaction of learned Additional Sessions Judge-Ist, Jehanabad.
