In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No. 1243 of 2017, registered for the offence under Sections 498(A)/34 of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.

Allegation has been made against the petitioner to have tortured the opposite party no.2 on account of nonfulfillment of dowry demand. Learned counsel for the petitioner submits that opposite party no.2 is living along with the petitioner and she

Patna High Court CR. MISC. No.18678 of 2019(2) dt.28-03-2019 2/2 has sworn an affidavit in this regard, attaching her Aadhar Card, which shows the name and address of Usha Kumari, wife of present petitioner.

Looking to the aforesaid facts, let the petitioner, namely, Praful Kumar @ Praphul Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Hazipur, Vaishali, in connection with Complaint Case No.1243 of 2017, Tr. No.2949 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
