JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Laheria Sarai P.S. Case No. 279 of 2015 disclosing offences under Sections 384, 504, 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report and his name has surfaced during investigation on the basis of statement of one co-accused, namely, Nitesh Singh @ Ghanti, who has been granted regular bail by the court below. However, keeping in view the nature of allegation, in my view, the petitioner's custodial interrogation might be required. I am not inclined to grant privilege of anticipatory
Patna High Court Cr.Misc. No.36871 of 2015 (2) dt.10-09-2015 2/2 bail to the petitioner.
This application for anticipatory bail is, accordingly, rejected. The Court expects that if the petitioner surrenders before the court below within a period of six weeks and applies for regular bail, the court below shall consider his application taking into account the facts on record, including the fact that other co-accused has been granted the privilege of regular bail.
