Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 421 of 2016 registered under Sections 420,467,468,471,120B of the Indian Penal Code and Section 7 of the E.C. Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case due to wrong fact. The petitioner is a government servant and the only allegation against him is that he failed to locate the truck. Also similarly situated co-accused has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 11996 of 2017 vide order dated 29.03.2017.

Patna High Court Cr.Misc. No.12063 of 2017 (2) dt.06-04-2017 Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within period of six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S. Case No. 421 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
