====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 363, 366(A), 504/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.

It is alleged that these petitioners along with other accused person assaulted the informant and his daughter and kidnapped his minor daughter for the purpose of marriage. Learned counsel appearing for the petitioners submits that specific accusation of assault and kidnapping is against Arman Miyan and these petitioners have been made accused in

Patna High Court CR. MISC. No.20610 of 2023(2) dt.28-06-2023 2/2 this case only because they are family members of the coaccused. Petitioner No. 1 is mother and petitioner No. 2 is brother of the main co-accused Arman Miyan. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge-cum-Special Judge POCSO Act, Motihari, East Champaran in connection with Sugauli P. S. Case No. 458 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
