The petitioner seeks bail in a case registered for the offence punishable under Sections 414/34 of the Indian Penal Code and Sections 25(1-B)A, 26, 27 and 35 of the Arms Act. As per allegation in the FIR, some firearms were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is in custody since 11.09.2023.

However, learned APP for the State opposes the prayer for regular bail of the petitioner.

On perusal of the first information report, seizure list

Patna High Court CR. MISC. No.24377 of 2024(2) dt.04-04-2024 2/2 and impugned order dated 12.01.2024, it appears that one country made pistol, one live cartridge and empty cartridge recovered from the possession of petitioner and also the petitioner has got six criminal antecedents, considering the recovery of two live fire arms and empty cartridge, I am not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is hereby rejected. However, the trial Court is directed to conclude the trial within a period of six months.
