JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-05-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kotwali Police Station Case No. 383 of 2016/ G.R. No. 5142 of 2016, disclosing offences under Sections 147, 148, 149, 353, 323, 504, 325 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that petitioners are innocent and have not committed any offence. There is no specific allegation leveled against the petitioners, who happen to be Tempo driver. The petitioners, who are of clean antecedent, are the sole bread earner of their family. Learned A.P.P. for the State has opposed the prayer for bail of these petitioners and submitted that the petitioners have assaulted the police personnel, resultantly, they sustained injuries. Moreover, the Dy. S.P. during supervision of the case has also found the case to be true against the petitioners. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of these petitioners is, hereby, rejected. (Arvind Srivastava, J.) brajesh/- U T
