JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Complaint Case No. 121 of 2015, disclosing offences under Sections 121 of 2015/ T.R. No. 829 of 2016 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that petitioner Nos. 1 and 2, who happen to be mother-in-law and father-in-law of the complainant and petitioner no.3 is daughter of petitioner Nos. 1 and 2, are innocent and have not committed any offence. In fact, these petitioners are living

Patna High Court Cr.Misc. No.10378 of 2017 (2) dt.22-03-2017 separately from the husband of the complainant. Cognizance has already been taken in this case under Section 498A and 3/4 D.P. Act. Hence, the petitioners deserve the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhubani, in connection with Complaint Case No. 121 of 2015/ Tr. No. 829 of 2016, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
