The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

According to FIR, 11 named persons including the petitioner indiscriminately fired on the son of the informant and his nephew. Both sustained firearm injury and subsequently died. The Doctor has found four firearm injuries on vital part of the body of deceased -Deepak Kumar and eight firearm injuries on the body of deceased Dinkar Singh.

Submission of learned counsel for the petitioner is that allegation is general and omnibus. The informant has

Patna High Court CR. MISC. No.18257 of 2019(4) dt.25-06-2019 2/2 dispute with co-accused Ranjeet Singh and the petitioner is helper in the family affair of Ranjeet Singh. Therefore, the petitioner has been falsely implicated in this case. Allegation is not specific against the petitioner. Petitioner is languishing in judicial custody since 04.11.2018 and he has no criminal antecedent.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. According his payer for bail is rejected in connection with Runnisaidpur P.S. Case No. 663 of 2018 pending in the court of the learned Chief Judicial Magistrate, Sitamarhi.

The application is, accordingly, dismissed.
