2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 04.08.2023 in Cr. Misc. No. 45622 of 2023.

3. The petitioner seeks bail in connection with Sessions Trial No. 397 of 2023 arising out of Naubatpur P.S. Case No. 211 of 2022 registered for the offence punishable under Sections 341, 323, 337, 338, 307 and 325/ 34 of the Indian Penal Code and added Section 302 of the Indian Penal Code.

4. The petitioner is one of the assailants of the deceased who was brutally assaulted by the petitioner along with others.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 22.11.2022.

6. Learned counsel for the petitioner submits that no witness has been examined in the trial. Either learned counsel for the petitioner is not taking instruction from his client or he is trying to mislead this Court as from the report of the trial Court dated 27.06.2024, it appears that out of six charge-sheeted witnesses two witnesses have already been examined.

7. In these circumstances, this application is dismissed with a direction to the trial Court to expedite the trial if the same has not already been disposed of.
