The petitioner seeks bail in Dhanaha P.S. Case No. 119 of 2018, registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code. It is alleged that the co-accused Radhika Devi used to allow the victim to talk to someone through the petitioner's mobile phone.
Learned Senior Counsel, appearing on behalf of the petitioner, contends that there is no allegation against the petitioner of any abetment or conspiracy leading to disappearance of the victim. He further contends that, even as per the case of the prosecution, Radhika Devi, the co-accused, was instrumental in helping the victim speak to someone, who
Patna High Court Cr.Misc. No.61969 of 2018(2) dt.06-10-2018 2/2 has been granted regular bail by the court below, which fact is not being disputed by the learned Additional Public Prosecutor. Considering the facts and circumstances and the submission advanced on behalf of the counsel for the petitioner, as noted above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M. 1st Bagaha, West Champaran in Dhanaha P.S.
