JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.
Petitioner happens to be maternal father in law of the deceased and according to prosecution case itself, the dead body of the deceased was found on a railway track and after that U.D. case bearing U.D. Case No. 02 of 2016 dated 30.01.2016 was registered which is evident from perusal of para-26 of the case diary. Subsequently, the informant, who happens to be brother of the deceased, lodged the present case on 25.04.2016 against the petitioner and others on the ground that relation of the
Patna High Court Cr.Misc. No.36464 of 2016 (3) dt.08-11-2016 2/2 deceased with his wife was not cordial and the location of mobile of petitioner and others was found in Village Patuaha on the alleged date of occurrence. The police after investigation submitted charge sheet only on the ground that location of mobile of petitioner was found in village Patuaha on the alleged date of occurrence. The investigation against the petitioner appears to have already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 354 of 2016.
