JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 The petitioner apprehends his arrest in connection with Special Case No. 9442/18, arising out of Chowk P.S. Case No. 393 of 2018, disclosing offences under Section 30(a) of the Excise Act and Section 25(1-b)a, 26 of the Arms Act. Allegation is of recovery of 80 litres of mahua liquor from the co-accused, who disclosed the name of petitioner as his associate.

Submission of learned counsel for the petitioner is that from the F.I.R. itself it is evident nothing has been recovered either from the house of the petitioner or at his instance, his name has falsely been roped in this case by the coaccused. Statement has been made in paragraph -3 that petitioner has no criminal antecedent.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 9442/18, arising out of Chowk P.S. Case No. 393 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
