This is a petition for grant of anticipatory bail for offence under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Six kilograms of ganja was allegedly recovered from possession of two other accused persons, who disclosed to the police that they are carriers and real owner of the ganja is this petitioner, who is relation of the arrested persons. Submission of the learned counsel for the petitioner is that the petitioner has got no criminal antecedent and confession of the co-accused before the police is no evidence against the petitioner in view of the provisions of the Evidence Act. Considering the nature of allegation and accusation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
The prayer for anticipatory bail is refused.
