The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/324/504/506/34 of the Indian Penal Code. Later on offence under Section 307 of the Indian Penal Code was added. There is allegation of commission of assault against the petitioner. The petitioner has stated on oath that he has got no criminal antecedent though FIR alleges that accused persons are criminals.
Considering the nature of allegation and statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on
Patna High Court CR. MISC. No.18910 of 2019(2) dt.28-03-2019 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Narpatganj Police Station Case No.295 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that if the Courtbelow would come to notice that petitioner has criminal antecedent it will be a ground for cancellation of bail bond by the learned Court-below itself.
