JUSTICE RAKESH KUMAR ORAL ORDER 16-12-2016 Heard Sri Krishna Prasad Singh, learned Senior Counsel, assisted by Sri Mithilesh Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Shankarpur P.S. Case No.79/2016 registered for the offence under Sections 20,22 of the N.D.P.S.Act and Section 47(a) of the Bihar Excise (Amendment) Act,2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated on an allegation of recovery of 11 bottles of India Make Foreign Liquor as well as about 2 Kg of Ganja. It has been argued that the recovered Ganja is much lesser than the commercial quantity, of course, it is above smaller quantity.

No.45836 of 2016 (2) dt.16-12-2016 2/2 However, keeping in view the clean antecedent of the petitioner ,as stated in paragraph-3 of the petition, as well as recovered quantity of Ganja, let the petitioner, namely, Pradeep Kumar Yadav be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Madhepura in connection with Special Case No. 09/2016 arising out of Shankarpur P.S.
