ANJANA PRAKASH ORAL JUDGMENT Date: 21-04-2016 In the nature of dispute between the parties an attempt was made to settle the same but it could not be done. The petitioner who is father-in-law of the Opposite Party no. 2 seeks quashing of the order of cognizance dated 10.05.2013 passed by the Sub-Divisional Judicial Magistrate, Jhanjharpur in Cr. No. 1098 of 2012.
The case of the complainant is that she was married to Shivji Ram about 15 years ago but unfortunately she was tortured for ends of dowry and finally ousted from the matrimonial home. It has been submitted on behalf of the Petitioner that he is living separately and it is impossible to believe that a person would be
Patna High Court Cr.Misc. No.31010 of 2013 dt.21-04-2016 2/2 tortured for 15 years for ends of dowry. Evidently there was some issue between the husband and wife on account of which present complaint has been filed roping in all the family members without reasonable cause.
Having gone through the nature of allegation and duration of marriage the application is allowed and the order of cognizance dated 10.05.2013 passed by the Sub-Divisional Judicial Magistrate, Jhanjharpur in Cr. No. 1098 of 2012 is hereby set aside so far as the petitioner is concerned.
