This application is filed on behalf of the petitioners for quashing the order dated 25.06.2015 passed by the Chief Judicial Magistrate, Samastipur in G.R. No. 2013 of 2010 and Trial No. 1752 of 2015 arising out of Samastipur Nagar P.S. Case No. 555 of 2010.

Learned counsel for the petitioners submits that in view of the letter dated 19.11.2010 the prosecution of the petitioner is not maintainable as the Deputy Superintendent of Sadar Hospital, Samastipur had written to the Officer-in-Charge that the appointment letters were received by the petitioners and there was no need for proceeding against the petitioners. In view of the letter dated 19.11.2010, this application is allowed.

Accordingly, the order dated 25.06.2015 passed by the Chief Judicial Magistrate, Samastipur in G.R. No. 2013 of

Patna High Court CR. MISC. No.40365 of 2015(2) dt.03-04-2023 3/3 2010 and Trial No. 1752 of 2015 arising out of Samastipur Nagar P.S. Case No. 555 of 2010 is hereby quashed. (Sandeep Kumar, J) Vikas/Shishir U
