Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 452, 387, 307, 394 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per F.I.R is that co-
Patna High Court CR. MISC. No.28706 of 2021(2) dt.03-02-2022 2/3 accused Shubham Kumar @ Lefty came at the door of the informant and fired at the informant which hit on his left thigh. He also shot fire at Binita Devi which hit on her right leg.
It is submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R and only on the confession of the co-accused Shubham Kumar @ Lefty he has been roped in the present case. The specific overt act is not alleged against the petitioner. The petitioner has no concern with the accused Shubham Kumar @ Lefty.
Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 273 of 2020,
