Having regard to the fact that the petitioner being Anganbadi Sevika is aggrieved by the order of his termination from service passed by the District Programme Officer and that she has moved the wrong forum by filing an appeal before the Collector of the Vaishali district but then within time period of 30 days, this Court would direct that if such appeal has been filed by the petitioner before the Collector of Vaishali district,

Patna High Court CWJC No.12018 of 2015 (2) dt.06-08-2015 copy of which has been annexed as Annexure-6 to this writ application, the same may be transferred to Deputy Director, Welfare, posted in the office of Divisional Commissioner of Muzaffarpur or to any other appellate authority authorized by the Divisional Commissioner, Muzaffarpur in the rank of Additional Collector as per the Government order dated 17.05.2013.

It is expected that upon the transfer of the appeal of the petitioner, the competent appellate authority shall pass his orders in accordance with law but of course after giving notice and/or opportunity of hearing to all affected parties.

With the aforementioned observation and direction, this application is disposed of.
