JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-08-2019 Heard Mr. Shivesh Chandra Mishra, learned counsel for the petitioner, Mr. Rajesh Kumar Sinha assisted by Mr. Dilip Kumar on behalf of Opposite Party No.2.

Petitioner apprehends his arrest in connection with Sabour P.S. Case No.202 of 2018 for the offence punishable under Sections 406, 419, 420, 341, 323, 506/34 of the Indian Penal Code.

During the course of argument, learned counsel for the petitioner submits that petitioner is ready to return a sum of Rs. 5 lakh in favour of Opposite Party No.2 within a period of one month. The offer made by the petitioner is accepted by learned counsel appearing for Opposite Party No.2 on instruction.

Patna High Court CR. MISC. No.22190 of 2019(5) dt.09-08-2019 2/2 Let bank draft of sum of Rs. 5 lakh be prepared and handed over to Opposite Party No.2 within a period of six weeks by the petitioner.

In view of the aforesaid, the petitioner, above named, is directed to surrender before the learned Court below within a period of eight weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No.202 of 2018, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.

It is made clear that at the time of surrender, the copy of the bank draft duly acknowledged by Opposite Party No.2 shall be annexed with the surrender-cum-bail application before the Court below.
