Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 342, 363, 366A, 323, 354B, 504, 34 of the Indian Penal Code. It is alleged that petitioners and others made an attempt to kidnap the informant but on alarm raised by the informant the accused persons left the informant and fled away.
It is submitted by learned counsel for the petitioners that due to the fight between the informant and sister of the petitioners the accusation has been levelled. The F.I.R reflects that occurrence is of 9.10.2014 at 6:30 P.M but the case was registered on the same day at 7:30 P.M, however
Patna High Court Cr.Misc. No.37494 of 2015 (2) dt.17-09-2015 2/2 the police station was about six kilometer from the place of occurrence.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 329 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
