JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Town P.S. Case no.265/16 for the offence under Sections 25 (1-b) a, 26 and 35 of the Arms Act and sections 53B and 54 of the Bihar Excise (Amendment) Act,2016.

The accusation is of recovery of wine and country made live cartridges from the possession of the petitioner along with other co-accused.It is further alleged that the accused persons could not produce any valid paper with respect to the aforesaid incriminating articles. They were arrested at the place of occurrence.

Considering the fact that the petitioner has got criminal antecedents I am not inclined to grant bail to the petitioner.

The prayer for bail of the petitioner is, accordingly, rejected.
