The petitioner apprehends his arrest in Biraul P.S. Case No. 329 of 2016 instituted for the offence under Section (s) 272, 273 of the Indian Penal Code and Section 47(a)(g) of the Excise Act. .

It is alleged that eight litres of country made liquor has been recovered from the house of the petitioner. The petitioner fled away on seeing the police party. The seizure list is enclosed with the written report. The seizure list does not bear the signature of either the petitioner or any family member of the petitioner, although it has been stated that the aforesaid liquor has been recovered from the house of this petitioner.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Biraul P.S. Case No. 329 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
