Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a)/33/34/36 of the Bihar Prohibition and Excise Act.
558 liters of liquor was recovered from the car in which the petitioner was there. The petitioner is in custody since 26.12.2020. The petitioner has stated on oath that he has got no criminal antecedent.
Considering the facts aforesaid, let the petitioner, above named, be released on bail after framing of the charges
Patna High Court CR. MISC. No.30761 of 2021(2) dt.25-10-2021 2/2 so that trial may not hamper on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bochahan P.S. Case No. 350 of 2020 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
