2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 21, 22 and 23 of the N.D.P.S. Act and Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with Laukahi P.S. Case No. 263 of 2023.
3. As per prosecution case, there has been recovery of total 31 bottles of Cough Syrup (each bottle contains 100 ml) from the possession of the petitioner.
4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. He submitted that the alleged cough
Patna High Court CR. MISC. No.24084 of 2024(5) dt.10-09-2024 2/2 syrup which is said to be recovered from the possession of the petitioner, is used as medicine. Petitioner is a person of clean antecedent and he is in custody since 06.10.2023.
5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Sessions Judge-V-cum-Special Judge, NDPS Act, Madhubani in connection with Laukahi P.S. Case No. 263 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court and further a condition that:- (i) One of the bailors shall be a resident of India.
