02. 05.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

It is contended on behalf of the petitioner that the allegation is against him of kidnapping the minor daughter of the informant. From the statement of the victim girl recorded under Section 164 Cr.P.C. it appears that the petitioner forcibly took her to sister's house but she was not subjected to any misbehaviour or sexual assault and within one hour she escaped from there and returned home. However, in the FIR it is stated that the victim girl did not return for about four days. It is further

Patna High Court Cr.Misc. No.42695 of 2016 (2) dt.05-10-2016 contended that the petitioner is in custody since 28.06.2016 and there is no allegation of any misbehaviour or sexual assault. Having regard to the facts and circumstances of the case, the petitioner, namely, Jitendra Manjhi is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Special Judge (POCSO Act), Gaya in connection with Roushanganj P.S. Case No. 66 of 2016 (POCSO Case No. 32 of 2016).
