JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks bail in connection with Jainagar P.S. Case No. 143 of 2018 registered for the offences punishable under Sections 409/34 of the Indian Penal Code. Allegation against the petitioner, who was exMukhiya of Gram Panchayat Raj, Dullipatti and as per order of Sub-Divisional Public Grievances Redressal Officer, Jainagar the FIR was instituted for illegal payment against 11th Finance Commission Scheme for the financial year 2003-04. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him and the Scheme was of the year 2003-04 and the case has been lodged after 12 years and the petitioner as Mukhiya had handed over all the papers and he is in custody since 22.12.2018 and he is ready to abide by any condition that may be imposed on him.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Madhubani, in connection with Jainagar P.S.Case No. 143 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear before the court as and when required.
