ANJANA MISHRA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 13.06.2016 in connection with Vijaipur P.S. Case No. 86 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 448 and 504 of the Indian Penal Code and under Section 27 of the Arms Act.

Case diary was called for, which has since been received.

Learned counsel for the petitioner submits that there is a case and counter case between the parties and both parties have received serious injuries. So far as the petitioner is concerned as it is alleged, he had inflicted serious injury on one Arun Mishra but

Patna High Court Cr.Misc. No.40050 of 2016 (3) dt.08-11-2016 2/2 the injuries alleged to have been made, has not been found substantiated in the injury report. Case diary also supports the submissions advanced by the petitioner.

Counsel for the informant is present and has pointed out to several paragraphs of the case diary but submissions so advanced do not stand supported by the injuries found on the person of the said Arun Mishra.

In view of such facts and circumstances of the case and also because the petitioner has already been in custody since 13.06.2016, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IV, Gopalganj in connection with Vijaipur P.S. Case No. 86 of 2016.
