JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2019 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 18.11.2018 in a case registered for the offences punishable under Sections 307 and 120B of the IPC and Section 27 of the Arms Act. The prosecution case is that on 30.09.2018 at about 2 P.M., while the informant was sitting outside his shop, in the meantime, two persons came and resorted to fire on the informant causing injury on his stomach, leading to registration of FIR against unknown. Subsequently, the informant raised suspicion against the petitioner since earlier, the petitioner asked the informant to depose in a case between which was pending between one Arun Ram and himself, but the informant had forbade him to depose in the said case.

It is submitted by learned counsel for the petitioner that

No.18694 of 2019(2) dt.29-03-2019 2/2 even assuming the accusation to be true, admittedly firing was not made by the petitioner and only on the basis of suspicion, the petitioner has been roped in the present. A statement has been made in paragraph no.3 of the petition that apart from present case, the petitioner is also made accused in other case, in which he is on bail.

Learned APP submits that name of the petitioner sprang subsequently on the basis of suspicion.

Considering the suspicious nature of accusation, investigation being already concluded and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 293 of 2018.
