JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 9.8.2017 passed in Cr.Misc.No. 35863 of 2017 and allegation against him is of attempting to kill his wife by knife.
Submission of learned counsel for the petitioner is that he is in custody for two years and only charge has been framed in this case as yet.
Heard learned APP also.
Having heard both sides and in the facts and circumstances and also considering the period of custody, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court Cr.Misc. No.63538 of 2018 (2) dt.10-10-2018 2/2 Additional District Judge-II, Jamui, in connection with Sessions Trial No. 135 of 2017, arising out of Laxmipur (Gidhaur) P.S.Case No. 115 of 2016, subject to the condition that one of the bailors shall be a family member of the petitioner having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
