The petitioners are apprehending arrest in a case registered under Sections 304B, 201/34 of the Indian Penal Code.
Informant alleges that his niece was killed by the accused persons including the petitioners due to non fulfilment of dowry demand.
It has been submitted on behalf of the petitioners that the petitioner no.1 is elder brother of the husband of the deceased, whereas petitioner no.2 is the wife of petitioner no.1. allegation against them is general and omnibus and husband of the deceased is already in custody. Petitioners reside separately
Patna High Court CR. MISC. No.22258 of 2019(4) dt.08-07-2019 2/2 from the victim and her husband and they have nothing to do with the affairs of the victim. Similarly situated co-accused Shatrudhan Ray, who happens to be maternal uncle of the deceased, has already been allowed bail by this Court by order dated13.2.2019, passed in Cr.Mis.No. 8206 of 2019. petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances, let both the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI cum Sub Judge, Patna in Beur Police Station Case No. 251 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
