Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) and 32(2) of the Bihar Prohibition and Excise Act.

Prosecution case is that 98.7 litres of foreign liquor was recovered from a mini truck.

Learned counsel appearing for the petitioner submits that the recovery has been made from the mini truck. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the prayer for bail and submits that petitioner is the registered owner of the vehicle in question.
