JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with Bakhtiyarpur P.S.Case No. 148 of 2020 for the offences punishable under Sections 341,323,324,379/34 of the Indian Penal Code.

As per prosecution case, informant was repairing his truck near by-pass, all the F.I.R named accused persons assaulted the informant. On the order of Shiv Dhari Yadav co-accused

Patna High Court CR. MISC. No.32436 of 2021(2) dt.23-02-2022 2/3 Mithlesh Kumar assaulted with iron rod on head and snatched Rs. Sixty thousand and gold chain.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case due to business rivalry. There are general and omnibus allegation against these petitioners. It appears from the injury report that no grievous injury was found on the person. Petitioners have got clean antecedent.

Learned Additional Public Prosecutor opposes the bail prayer of the petitioners.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S Case No. 148 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
