JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-06-2023 This application has been filed for modification for order dated 22.04.2022 passed in Cr. Misc. No. 14852 of 2021. The petitioner was granted bail on the assurance that he shall refund the entire amount of Rs. 8,75,000/- to the informant/complainant vide order dated 22.04.2022 passed in Cr. Misc. No. 14852 of 2021.

The petitioner could not arrange the money, as such, he filed a petition for extension of time to surrender, which was allowed vide order dated 09.11.2022 in Cr. Misc. No. 59622 of 2022 and four weeks' time was granted to the petitioner to refund the entire money to the informant.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.33522 of 2023(2) dt.28-06-2023 2/2 that the entire money has been refunded to the informant through co-accused Ashok Kumar.

The learned court below shall verify this fact and if the entire money is found to be refunded, the petitioner in the event of his arrest or surrender within a period of four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Danapur P.S. Case No. 745 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Accordingly, this petition is disposed of.
