This application is for grant of bail in connection with S.T.Case No.105/2016(CIS No.143/2016 arising out of Bihariganj P.S.Case No.32 of 2016 (G.R.No.165/2016) for the offence under Sections 363, 365 and 379 of the Indian Penal Code. It is submitted on behalf of the petitioner that except the confessional statement, there is nothing against the petitioner and he is in custody since 28.03.2016.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides. From perusal of the case diary, it appears that on the basis of confessional statement of the coaccused, the dead-body was recovered from one ditch, as such I
Patna High Court Cr.Misc. No.52111 of 2016 (4) dt.21-02-2017 2/2 am not inclined to grant bail to the petitioner, however, as the petitioner is in custody since 28.03.2016 and the case has already been committed to the court of Session, the learned trial court is directed to expedite the trial and try to conclude it within a period of one year.
With the aforesaid observation, this application is dismissed.
