JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Beldour P.S.Case No. 124 of 2018, G.R. No.1912 of 2018, registered for offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is of kidnapping the daughter of the informant.

Submission of the learned counsel for the petitioner is that the statement of the girl has been recorded under Section 164 Cr.P.C. in which she has denied the prosecution story and the petitioner is in custody since 28.07.2018.

Heard learned A.P.P, who opposes the prayer for

Having heard both sides and from perusal of the statement of the victim girl recorded under Section 164 Cr.P.C. is that there is no doubt that she is minor but not supported the prosecution case and the petitioner is in custody since 28.07.2018, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of Miss Simmi Kujur, Judicial Magistrate 1st Class, Khagaria in connection with Beldour P.S.Case No. 124 of 2018, G.R. No.1912 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
